With botnets still representing a rapidly growing threat to Internet users, various techniques and methods have been and continue being developed in order to reduce the threat that botnets pose to the security of information systems connected to the internet. It turns out, however, that the chances those fighting botnets to be hold legally liable for their actions are not negligible.

A joint report by the Estonia-based NATO Cooperative Cyber Defence Centre of Excellence and the European Network and Information Security Agency (ENISA) was published in the beginning of the week and looked at the legal implications of countering botnets.

In the beginning, the report comprehensively defined botnets as: ?networks of interconnected, remote-controlled computers generally infected with malicious software (compromised or hijacked computers) turning the infected systems into so-called ?bots?, ?robots? or ?zombies?.

The study examined the legal implications of the implementation of anti-botnet techniques, concluding that ?Potential restrictions to technological countermeasures may arise from basically any field of law, including administrative, civil and criminal law?.

In addition, the results of the report showed that traffic monitoring, as well as botnet takedown and takeover techniques, were surrounded by an array of legal concerns, which, if not addressed properly, could invoke the liability of the botnet fighters.

According to authors, personal data protection violations and illegally breaking the confidentiality of communications were primary concerns which related to packet and traffic inspection. In their opinion, unauthorised botnet takeover or takedown might fall under many criminal law provisions.?

The report looked at the various anti-botnet techniques and methods and concluded that court practice regarding botnets in general was very limited and many botnet countermeasures addressed in the study were neither explicitly permitted nor prohibited by the law.

The authors emphasised that if there was to be a dispute in the future, it would be up to the courts to determine the unlawfulness of the act in question. This is why they recommended the following: ?To avoid facing a potential court case, persons or organisations looking to take up anti-botnet activities should seek for appropriate legal advice beforehand?.

The joint CCDCOE-ENISA study also recommended that legislators use their mandate to shape national laws so that they support rather than hinder the fight against botnets.

AT&T, govt reach deal on data plan complaints

(AP) ? AT&T agreed to pay the federal government $700,000 and offer refunds to customers for mistakenly forcing some smartphone users into monthly data plans.

In late 2009, AT&T began to require new smartphone customers to subscribe to monthly data plans. Existing subscribers with pay-per-use plans or no plan at all had to get a monthly plan when they upgraded to a new smartphone.

The requirement wasn't supposed to apply when subscribers replaced a lost or broken phone through an insurance program or warranty, or if they moved to a different AT&T service area. But a computer error moved those customers into monthly plans anyway.

AT&T Inc. now must offer to restore the older plans and give refunds, which the Federal Communications Commission said could be up to $30 a month.

AT&T said that the issue affected a small number of customers and that those who contacted AT&T had already been given refunds. Tuesday's agreement with the FCC requires the Dallas company to post notices on consumers' bills and offer them a chance to return to a pay-per-use plan or drop data use entirely.

How Close Was This Election?

There seems to be some confusion about whether or not the United States just witnessed a close election. Perhaps some historical perspective can help: Yes, this was a close election.

If we include Florida, Obama appears to have won 332 electoral votes to Romney?s 206. In the popular vote, the latest numbers suggest an Obama victory of 50.4 percent to Romney?s 48.1.?This is not recount territory. Measured by the standards of the 20th?century, though, it reflects a genuinely tight race.

Between 1900 and 1999, only five of the 25 presidential elections were decided by fewer than 130 electoral votes. Only three had a popular vote margin smaller than the Obama-Romney contest. It?s a sign of how accustomed we?ve become to razor-thin margins of victory that Obama?s 2.3-percent popular-vote victory seems almost like a rout.?

For much of the 20th?century, decisive elections were the rule rather than the exception. In the 1920s, Republicans won all three presidential elections with anywhere from 54 to 60.3 percent of the popular vote. During 1930s and 1940s, the balance flipped, with Franklin Roosevelt winning anywhere from 53.4 to 60.8 percent of the popular vote, and as much as 98.5 percent of the Electoral College. That extraordinary run came to an end with the nail-biter of 1948, in which Harry Truman was widely predicted to lose to Republican Thomas Dewey. Even that race, though, turned out to have a wider popular margin of victory than Obama-Romney. When the votes were tallied, Truman won with 49.5 percent of the popular vote to Dewey?s 45.1 percent, and 303 electoral votes to Dewey?s 189.

The closest election of the 20th?century was the bitterly contested showdown between John F. Kennedy and Richard Nixon in 1960. Kennedy won the electoral college by a decisive if not overwhelming margin, garnering 303 electoral votes to Nixon?s 219. But the popular vote was more or less a tie, with Kennedy claiming just 49.7 percent to Nixon?s 49.5, amid widespread accusations of corruption and vote-buying.

Nixon came back eight years later with a squeaker of his own, winning over Hubert Humphrey by 0.7 percent of the popular vote. It?s worth noting, though, that both of these close elections were followed by absolute blowouts. In 1964, Lyndon Johnson?s trounced Barry Goldwater with 61.1 percent of the popular vote and 486 electoral votes. In 1972, Nixon won a landslide of his own, claiming 60.7 percent of the popular vote and a whopping 96.7 percent of the Electoral College. Whatever else was happening during those years, it was not an era of consistently close elections.

Outside of the 1960s, the tightest races of the 20th?century produced popular-vote margins roughly comparable to Obama-Romney.?In 1916, Woodrow Wilson won a second term with a popular-vote victory of 49.2 percent, to 46.1 percent for Republican stalwart Charles Evans Hughes. In 1976, Jimmy Carter rousted Gerald Ford 50.1 percent to 48. The electoral vote, in both cases, was narrower than Obama?s 2012 victory.

Other than that, every single election of the 20th?century was decided by a larger popular or electoral margin than we?ve seen in 2012. Almost one-half of the century?s elections were decided by popular margins of more than 10 percent. What?s extraordinary about the present moment is not so much the narrow margin of victory as the consistent run of close elections. Americans who lived through the 1916 election had to wait more than three decades for a comparably tight contest. By contrast, three out of four of our last elections have been decided by a popular-vote margin of less than 3 percent. The time we saw anything approaching a landslide was Ronald Reagan?s victory in 1984.

In that sense, our own political moment best resembles the Gilded Age of the late 19th?century, the last sustained period when close elections were the norm. Historians usually describe the Gilded Age as an uninspiring era in national politics, when party machines, back-room power-brokers, and a campaign-finance free-for-all led to lackluster national debate. It was also an era in which politics were unusually partisan, often at the expense of tackling the genuine challenges facing the nation: growing inequality, immigration, corporate power, urban development.

Lest this all sound too familiar, it?s worth noting some important differences: the presidency was less powerful in the 19th?century and the electorate consisted mainly of white men. But the Gilded Age has at least one lesson to offer about what our repeated run of close elections might mean. Conventional wisdom suggests that close elections reflect a divided electorate: red/blue, liberal/conservative, Republican/Democrat. The Gilded Age suggests that close elections may in fact be a sign that nobody, on either side, is thinking big.

Diabetes study: 'Mindful eating' equals traditional education in lowering weight and blood sugar

ScienceDaily (Nov. 8, 2012) ? Eating mindfully, or consuming food in response to physical cues of hunger and fullness, is just as effective as adhering to nutrition-based guidelines in reducing weight and blood sugar levels in adults with Type 2 diabetes, a new study suggests.

In a comparison study of the effectiveness of the two types of behavioral interventions, participants lost about the same amount of weight -- an average of between 3 1/2 and 6 pounds -- and lowered their long-term blood sugar levels significantly after three months.

One treatment group followed an established diabetes self-management education program, with a strong emphasis on nutrition information. The other group was trained in mindful meditation and a mindful approach to food selection and eating. Both interventions, involving weekly group meetings, also recommended physical activity.

"The more traditional education program includes general information about diabetes, but with more emphasis on nutrition and food choice: What are different types of carbohydrates and fats and how many am I supposed to have? What should I look for when I read a food label? What are healthy options when dining out? That was the traditional diabetes education program," said Carla Miller, associate professor of human nutrition at Ohio State University and lead author of the study.

"We compared it to an intervention where mindful meditation was applied specifically to eating and food choices. This intervention group did not receive specific nutrition goals. We said we want you to really tune into your body before you eat. Take a few minutes to assess how hungry you are and make conscious choices about how much you're eating. Stop eating when you're full.

"We studied two very different approaches, and we found they both worked. This means people with diabetes have choices when it comes to eating a healthy diet," Miller said.

The research is published in the November issue of the Journal of the Academy of Nutrition and Dietetics.

Participants were adults between age 35 and 65 years and had been diagnosed with Type 2 diabetes for at least one year. To be eligible, they had to have a body mass index, a measure of weight relative to height, of 27 or more, indicating they were overweight, and a hemoglobin A1c (HbA1c) reading of at least 7 percent. HbA1c measures blood glucose levels in the previous two to three months; normal HbA1c is 5.6 percent or lower.

Study participants were randomly assigned to a treatment group. Twenty-seven completed the mindful eating program, and 25 completed the traditional diabetes self-management program called "Smart Choices." Each intervention involved eight weekly and two biweekly 2 ?-hour sessions with trained facilitators.

Trainers of the mindfulness program encouraged participants to cultivate "inner wisdom," or mindful awareness related to eating, and "outer wisdom," which referred to personal knowledge of optimal nutrition choices for people with diabetes. Each session included guided meditation oriented toward participants' experiences and emotions associated with food. Participants received CDs for help with home meditation practice.

"We have so many environmental cues to eat in America that we've tuned out our normal physiological signals to eat. Being mindful means stopping long enough to become aware of these physiological cues," Miller said. "We also tried to generate awareness, staying in the moment, and living and eating in response to hunger instead of habits and unconscious eating."

The mindful intervention also included basic information about what is known as medical nutrition therapy: the relationships among calories consumed, carbohydrate and fat intake, weight regulation and high blood sugar.

In contrast, the Smart Choices program focused specifically on the condition of diabetes itself, including factors that can lead to the diagnosis, common complications (which include heart disease, kidney and nerve damage, eye problems and stroke), the importance of blood sugar control, and appropriate food choices when blood sugar levels spike. Every session included a medical nutrition therapy discussion such as calorie-intake goals, percentages of carbohydrates and fats in an ideal diet, and portion control. Many sessions included a 15- to 20-minute walk to further emphasize the recommendation for regular physical activity. Problem-solving regarding choosing healthy foods in high-risk situations, such as the holidays, were a focus of the program.

The interventions took place over three months. Researchers assessed participants' health measures and dietary habits immediately after the programs concluded and then again three months later at the study's end.

Weight loss and improvements in HbA1c levels were similar for both groups at the six-month follow-up point. Smart Choice participants as a group lost more weight, an average of 6 pounds, than did the mindful eating group, which lost an average of 3.5 pounds -- but the difference was not significant when analyzed statistically, Miller said.

HbA1c levels dropped in both groups as well, by between about 0.7 and 0.8 percent. "That was a clinically meaningful reduction in Hba1c, equivalent to what you would get on some diabetes medications," Miller said. "If the reduction were sustained over time, it would mean a dramatic reduction in complications associated with diabetes."

Both groups also similarly reduced calorie intake and lowered their consumption of foods with a high glycemic index, which are digested quickly and can drive up blood sugar.

Miller said that because nutrition education is particularly important to people with a new diabetes diagnosis, she sees the mindful meditation and eating option as a potential supplement to basic diabetes education that patients need.

She also said that participants adapted well to the concept of mindfulness even though it is generally considered an alternative health practice.

"One of the things we were evaluating was how well this was accepted by people who had no experience with it. It was very well accepted by participants in that group," she said. "And this tells us that people with diabetes have choices.

"The fact that both interventions were equally effective suggests that we should let people choose. If mindful meditation is appealing and people think that approach is effective, then it very well could be the best choice for them."

Apple reportedly considers dropping Intel

Could Apple and Intel be heading for a divorce?

That?s the word from Bloomberg, which reported Tuesday that Apple is considering discontinuing using Intel?s chips in its Mac computers. Ironically, one of the reasons Bloomberg cites for the possible switch is the same reason that Apple switched to Intel in the first place: Apple?s demand for lower power chips.

When Apple switched from the PowerPC architecture to Intel in 2005, its overriding concern was the inability of the PowerPC coalition ? IBM and Motorola ? to design the kind of low-power chips that could power its notebooks. Apple feared that its notebooks would become increasingly uncompetitive with those running on Intel?s chips.

Thanks in part to the switch, Apple?s laptops again became competitive with its Windows rivals, and the company was able to create ever slimmer and lighter designs, including the MacBook Air. Apple?s computer sales have outpaced the broader industry basically since the switch.

But according to Bloomberg, the company has had longstanding concerns about Intel?s focus on delivering low-power chips. Apple?s slimmer, lighter designs depend on minimizing the space needed for batteries ? and thus the amount of energy the batteries can store. And with the Retina Displays in Apple?s newest computers having a voracious appetite for power, there?s even less that Apple?s computers can devote to processing power.

Intel addressed Apple?s immediate concerns last year, but the company is continuing to explore its options, according to Bloomberg. While Intel dominates the PC market, it has struggled to produce chips that are competitive with those designed by ARM, the company whose technology underlies the chips used in the vast majority of smartphones and tablets.

Apple itself chose to use ARM-based chips in its smartphones and tablets after first considering using Intel processors. Apple now designs its own chips based on ARM?s technology.?Such Apple-ARM chips could eventually power Apple?s Mac computers, Bloomberg says.

Should Apple move in that direction, it would be following in the footsteps of Microsoft, Google and Samsung. Microsoft recently released a version of its new Windows 8 software that?s compatible with ARM chips. It marked the first time that a version of Windows can be run on ARM-based machines. The company even went a step farther, releasing its own ARM-based tablet to which users can attach a keyboard and use almost like a laptop.

Similarly, Samsung last month released a ARM-based laptop computer running Google?s Chrome OS. It?s the first Chromebook to run on ARM; previous models ran on Intel chips.

While power concerns are a big driver of such moves ? ARM-based machines tend to be more efficient and offer longer battery life than Intel ones ? there are other explanations as well. With ARM-based chips, manufacturers like Apple can customize the designs to their particular needs. They can also have them made by a variety of chipmakers instead of just relying on one source. And using the same chips in phones, tablets and PCs could allow software and operating system makers to ?design apps and programs that will run commonly on all three.

While Intel chips have tended to have an edge on ARM designs in pure processing power, that advantage has become less important with the rise of broadband Internet access and cloud-based processing. Thanks to such factors, much of the processing power that users formerly needed on their PC can now be offloaded to computers on the Internet.

Consumers have long used Web-based email services such as Hotmail. But they are increasingly turning to the Web for office applications and even processor intensive things like hard-core gaming, computer-assisted design and photo editing.
